House Bill 1628 took effect September 4, 2026, replacing the emergency order with permanent controls for pure leaf and specified kratom alkaloid derivatives.

The law places elevated 7-OH above its thresholds, mitragynine pseudoindoxyl, MGM-15, MGM-16, 7-acetoxymitragynine, and covered kratom alkaloid derivatives in Schedule I. It creates a future licensed market for pure leaf containing no more than 0.05% 7-OH by dry weight, limited to adults 21 and older, with testing, labeling, locked-display, and product-form rules. Extracts and products mixed with non-kratom substances other than an inert capsule are excluded from lawful retail. Because the attorney general may not issue licenses until administrative rules are adopted, all kratom sales remain prohibited during the implementation period; adult possession of compliant pure leaf is not described as prohibited.
